Protecting Your Driving Privileges
That is how long after a DUI arrest that the state of Illinois automatically suspends your driver's license if there is no motion made to try to stop it. The suspension will be for between 6 months and 12 months for a first offender and 12 months to 3 years for a repeat offender. For many clients, the threat of losing their license for even one day is worse than any other aspect of a DUI case.
What We Do for You
One thing that repeatedly separates Mike Norris and John Callahan from other lawyers is that they take every possible step to beat this suspension. They file the proper motions immediately upon being retained - this can stop the 46 day suspension clock from working against you and against the State. They subpoena the video and audio dispatch tapes to ensure that all discovery is preserved and protected for your defense.
Rather than let the suspension automatically go into effect, Mike and John will file the necessary motions to stop it. If you contact Michael T. Norris and John W. Callahan immediately after your arrest, they can file the motions that put a 30 day clock against the State. If the State or local prosecutor does not give you a hearing on those motions within 30 days or the first court date, they will not be able to suspend your license at all – most importantly, you will not lose your ability to drive and the suspension will be taken off your record.
If you bury your head in the sand and take no action to defend yourself after being arrested for DUI, your license will be suspended. If you take aggressive action immediately to fight the suspension, the results are often very positive. You can't win unless you put yourself in a position to win. That is why it is so important to contact us right away.
