JOHN CALLAHAN: If a commercial truck driver is found guilty of a DUI, their CDL can be disqualified for a year. Even if a person is not driving the commercial vehicle when they're pulled over for a DUI, they can still lose their CDL privileges if they're found guilty of a DUI. CDL holders have a zero tolerance policy when it comes to alcohol when they're driving their CDL vehicle. If a CDL driver blows over a 0.00, their CDL license will be disqualified for up to 12 months, especially if he blows over a 0.04 on that result. You have a very short period of time before your CDL is actually disqualified, 46 days from the date of arrest. Contacting an attorney right away is very important because they can take steps to contest the disqualification. We've typically been able to get DUI charges reduced down to reckless driving, where that client would not lose his CDL license. We're able to sometimes beat the statutory summary suspension, which then would nullify the CDL disqualification as well. If you don't do this and you don't have an aggressive defense, the CDL will be disqualified.
