If a client is caught driving while suspended "in the box" on a statutory summary suspension will the DUI suspension be extended? The answer to that question as a DUI lawyer knows depends on whether or not the defendant receives a sentence of court supervision or if he receives a conviction. A conviction will extend the statutory summary suspension for the exact amount of time as the original suspension. For instance, if the suspension was for one year the additional suspension will be one year. If the suspension was three years the additional suspension will be three years only if the client is convicted on the subsequent 6-303 charge (driving while license suspended).
This is why it is important for a defense and DUI attorney in Wheaton or anywhere in DuPage County to try to get a disposition of court supervision for a driving while suspended charge if the client was suspended for DUI and the 6-303 occurred during that suspension.
