As a DUI lawyer who practices in Carol Stream, Illinois, I have represented many clients who have been arrested for DUI charges stemming from an arrest on North Avenue, otherwise known as Route 64. I would always advise my clients to refuse a breathalyzer test if they had the opportunity to ask me before they were arrested for DUI. The reason for this is that Carol Stream has less evidence to prosecute a DUI client when there is a refusal as opposed to when the client submits to a breathalyzer test. As most stops on North Avenue in Carol Stream occur as a result of speeding, the prosecution would have less evidence to use against a DUI client due to the fact that speeding is not an indicator of intoxication based on the NHTSA manual for field sobriety testing.
